Montenegro Water Tours

Article 1 – General
1. Montenegro Water Tours offers boat tours, water taxis, and boat rental in Boka Bay and surroundings.
2. The Montenegro Water Tours employee (skipper or rental contact person, whichever may apply throughout this agreement) is always in charge. Safety is paramount.
3. By booking a ticket or renting a boat you are accepting the terms and conditions of Montenegro Water Tours.

Article 2 – Bookings and payments
1. Boat tours and water taxis are booked per group. The client making the booking must be 18 years or older. Reservations can be booked through the online ticket shop or by contacting us directly. Montenegro Water Tours will send a confirmation of the booking to the client.
2. The boat tours, water taxis, boat rental, and any catering must be paid by bank transfer to our bank account prior to departure, or upon departure to the Montenegro Water Tours employee by POS machine or in cash. If the payment was done via bank, the client must show proof of payment to Montenegro Water Tours employee. This condition does not apply for long-term agreements, in which details are stated separately.
3. Rental may include a deposit to be paid in cash to the Montenegro Water Tours employee prior to departure, which will be reimbursed after return of the boat in its original state, including a full petrol tank, disposal of rubbish, and a complete inventory.
4. If clients show up late for departure, or request a stop-over or detour, they will be charged additional cost.

Article 3 – Communication
1. At the departure time, the client must have a mobile phone that is switched on and is contactable using the contact number provided during the booking process.
2. For boat rentals: for safety reasons, the client must have a fully charged mobile phone that is switched on at all times.

Article 4 – Check-in and departure times
1. Clients should try to be at the vessel at least 15 minutes before the departure time of a boat tour or water taxi, or for the handover of the rental boat. If you arrive at the boat later than the scheduled departure time, the agreement may be cancelled at the discretion of Montenegro Water Tours. The client’s payment obligation remains existent.
2. All departure times are current and up to date on the relevant tours info page, or as agreed directly with the client. Montenegro Water Tours is not liable for any conflicting information found in any other locations.
3. For boat rentals: upon pick up, the client that will be driving must bring a valid passport or ID, and an up to date motor boat licence; he/she must be 18 years or older and is responsible for the boat and all passengers. Montenegro Water Tours reserves the right to decline to hand over a boat to the driver if he/she does not seem able to take up this responsibility, notwithstanding references, certificates or other showed titles.

Article 5 – Boat tours, water taxis, and boat rental
1. Boat tours and water taxis by Montenegro Water Tours always include one or two skippers. Boat rentals may or may not include any skippers, depending on what was agreed in advance.
2. Boat tours or water taxis can take place on different vessels than what is shown on the Montenegro Water Tours website. Bookings may be transferred to an alternative vessel than what was originally booked, but should be of a similar category. Montenegro Water Tours will, as far as possible, inform clients thereof in a timely manner.
3. For boat tours and water taxis, Montenegro Water Tours reserves the right to change routes as well as start and end locations when weather conditions, shallows, or other legitimate reasons so require. Montenegro Water Tours will, as far as possible, inform clients thereof in a timely manner.

Article 6 – Execution of the contract
1. Valid reasons for annulment of a boat tour, water taxi, or boat rental are weather conditions (storm and/or high water) hindering or making the cruise impossible. The Montenegro Water Tours employee determines in the first instance whether such conditions apply. This condition does not apply for long-term agreements.
2. Alcohol under the age of 18 is prohibited. Montenegro Water Tours reserves the right to request a photo ID. In case of misconduct, whether or not caused by alcohol consumption, the Montenegro Water Tours employee has the right to pause or immediately terminate the trip. Persons who are already under the influence of alcohol/drugs at the start of the boat tour, water taxi or boat rental will be denied access to the boat. The client’s payment obligation remains existent.
3. For boat rentals, the use of alcohol is strictly forbidden for the skipper.
4. Clients must follow all instructions of Montenegro Water Tours employees and crew on quay and jetty promptly and without delay. Access to vessels and jetties may be denied without a reason being provided, should this be deemed necessary by Montenegro Water Tours, for example in relation to capacity, safety, public order or the imminent threat of damage or nuisance.
5. It is not allowed to sublet the boat or charter booking to a third party.
6. Clients are not allowed to bring more passengers on board than the number of persons indicated for each boat.

Article 7 – Liability
1. Montenegro Water Tours is not liable for any damage to and/or loss of the client’s property. The client takes all their property on board entirely at their own risk.
2. Montenegro Water Tours is not liable for damages to individuals or clients’ goods, caused by entering or boarding a jetty or boat. The client enters these areas entirely at their own risk.
3. The client is liable for any damages caused by the client to the property/goods of Montenegro Water Tours or their direct third parties, as well as any damages caused to other individuals, properties or goods.
4. All activities (boat tours, water taxis and boat rental) take place entirely at the clients’ own risk. Montenegro Water Tours is not liable for personal injury or damage of any nature, regardless of its cause, prior, during or as a result of a tour, water taxi, or boat rental. The exception to this is damage caused by a deliberate act or the gross negligence of Montenegro Water Tours. The statutory damages are limited to the price of the boat charter in question.
5. Children fall under the responsibility of the parent(s). On request upon booking: a life jacket can be provided free of charge. Montenegro Water Tours recommends that children wear lifejackets on the water.

Article 8 – Check out, damages or accidents
1. For boat rentals, the vessel must be returned in the original state in which it was provided to the client, including full petrol tank, disposal of rubbish, and complete inventory. Any damages (e.g. on the propeller in shallow water, loss of equipment, etc.), lack of petrol, or cleaning services must be paid by the client.
2. For boat rentals, in the case of any accident or damage to the boat to any other craft, property or individual, the client must notify Montenegro Water Tours immediately reporting full details. In case of damage to the boat: no action should be taken by own initiative, but wait for our instructions.
3. In case of technical problems not caused by the client (e.g. sudden engine failure), Montenegro Water Tours will try to find a replacement vessel as soon as possible, or an agreement can be ended by either party from the moment of breakdown. In case of such cancellation, Montenegro Water Tours will refund the cost of the remaining time of the tour, taxi or rental. In case the damage is caused by the client, Montenegro Water Tours may choose not to offer any replacement, and the client needs to pay for the damages.

Article 9 – Cancellation and amendments
1. In the case of a booking for boat tours, water taxis or boat rentals: for cancellations within 30 days prior to the day of departure 50% of the total cost are due. For cancellations within 7 days before the day of departure, the full price is due. This condition does not apply for long-term agreements, in which details are stated separately.
2. For catering bookings, a change in the number of people can be made until 24 hours prior to departure.
3. The client may modify or cancel the order in writing only.
4. In the case of extreme weather conditions we will set in consultation and without additional charge, a new date that is going to be carried out within 60 days, pending availability. This condition does not apply for long-term agreements.

Article 10 – Final provisions
1. The client is expected to take care of the environment and not to dispose of waste in the water. All personal consumptions and the associated waste should be taken off the boat after the end of the trip.
2. Obvious errors and mistakes in the information provided, and/or published by Montenegro Water Tours will not bind Montenegro Water Tours. The Montenegrin consumer law applies to these general terms and conditions. Disputes must be submitted to the competent court in Montenegro.
3. Clients should note that one enters the vessel by stepping off the quay onto the vessel. These are not wheelchair accessible.
4. Wearing heels is strictly prohibited for reasons of safety and damage to the vessel.
5. There are no toilets on most of our vessels.
6. The luxury marinas around Boka Bay offer mooring docks, toilets, and bathrooms with showers. Whilst these costs are covered by Montenegro Water Tours in the Porto Montenegro marina, for other locations these are at the client’s expense.

Article 11 – Complaints
1. If the participant finds a shortcoming in the implementation of the agreement, Montenegro Water Tours shall be notified as soon as possible, so that Montenegro Water Tours can find an appropriate solution. If the shortcoming is not resolved within a reasonable period of time and affects the quality of the arrangement or activity, this should be reported as soon as possible to Montenegro Water Tours.
2. If the complaint is not satisfactorily dealt with on the spot, it can be submitted within 14 days from the end of the arrangement or activity in writing to Montenegro Water Tours. A clearly specified account of what the complaints are should be presented.
